These Terms of Service govern your access to Hungry8, including the Hungry8 website, iOS app, restaurant owner portal, restaurant claiming tools, reviews, photos, points, and related services. Hungry8 is operated by Whistling in the Dark Ventures LLC DBA Hungry8. By using Hungry8, you agree to these terms.

If you use Hungry8 for a restaurant, food truck, brand, company, or other organization, you confirm that you have authority to bind that organization to these terms.
1. What Hungry8 Does
Hungry8 helps people discover places to eat, compare restaurant information, save favorites, check in, leave reviews or photos, and receive recommendations based on location, preferences, and platform data. Hungry8 also gives restaurant owners tools to claim listings, update business information, view analytics, manage customer engagement, and purchase business features.
Hungry8 is a discovery and marketing platform. We are not a restaurant, food preparation service, delivery provider, health advisor, or emergency service.
2. Eligibility
- You must be at least 13 years old to use Hungry8.
- If you are under the age of majority where you live, you may use Hungry8 only with permission from a parent or legal guardian.
- You may not use Hungry8 if we previously suspended or removed your account for violating these terms.
3. Accounts and Security
Some features require an account. You are responsible for the information you provide, for keeping your login credentials secure, and for activity under your account. Tell us promptly if you believe your account has been accessed without permission.
We may suspend, restrict, or terminate accounts when we believe a user is violating these terms, creating risk for other users or restaurants, abusing the service, or breaking the law.
4. Restaurant Information
Restaurant information may come from public sources, mapping providers, restaurant websites, owner submissions, user contributions, and Hungry8 verification workflows. We work to keep information useful, but we cannot guarantee that every listing, menu, price, photo, location, offer, or hour is complete, current, or error-free.
Always verify important details directly with the restaurant before visiting, ordering, relying on dietary information, or making travel plans. Restaurants are responsible for the food they prepare, the accuracy of information they submit, and their own customer experience.
Hungry8 is not a medical, nutrition, allergy, or food-safety authority. Dietary, allergen, ingredient, nutrition, and cross-contact information can be incomplete or wrong, so users with allergies or dietary restrictions must verify directly with the restaurant before eating.
5. Location Features
Hungry8 uses location-related features to show nearby restaurants, verify visits, support check-ins, improve recommendations, and help restaurant owners understand engagement. Location accuracy depends on your device, settings, network, and third-party map services.
You should not use Hungry8 while driving or in any situation where using an app would be unsafe.
6. Reviews, Photos, and Other User Content
You may be able to submit reviews, photos, profile details, comments, restaurant corrections, and other content. You keep ownership of your content, but you grant Hungry8 a worldwide, non-exclusive, royalty-free license to host, store, copy, display, publish, moderate, adapt, and use that content to operate, improve, promote, and protect Hungry8.
You are responsible for content you submit. Do not submit content that is false, misleading, illegal, infringing, private, abusive, harassing, obscene, threatening, hateful, spammy, or unrelated to the restaurant experience.
We may remove, edit, limit, label, or refuse content at our discretion, including content that appears fake, manipulated, incentivized in a misleading way, or otherwise harmful to trust on the platform. We do not promise to publish or preserve any user content.
To report abusive content, fake reviews, impersonation, harassment, illegal content, or other misuse, contact support@hungry8.com. We may provide in-app reporting, blocking, or moderation tools as Hungry8 features expand.
7. Verified Visits, Points, and Rewards
Hungry8 may offer visit verification, points, rewards, gift cards, campaigns, streaks, referrals, or other incentives. These features are promotional, may be changed or discontinued, and have no cash value unless we expressly say otherwise.
- Points are not money, are not stored value, and are not transferable unless Hungry8 allows it.
- Points and rewards may require verification, moderation, minimum thresholds, partner participation, or account standing.
- We may reverse points, deny rewards, or suspend accounts for fraud, abuse, fake visits, manipulated reviews, duplicate accounts, automated activity, or other misuse.
- Reward availability, redemption options, and third-party gift card terms may change.

8. Restaurant Claims and Owner Tools
Restaurant owners or authorized representatives may claim listings and access owner tools. We may require verification by email, phone, documents, payment records, business records, manual review, or other methods. Submitting a claim does not guarantee approval.
If you claim or manage a restaurant, you agree that your submitted information is accurate, you have authority to manage that listing, and you will not impersonate another business or interfere with another owner. We may approve, reject, revoke, transfer, or review claims to protect users, businesses, and platform integrity.
9. Paid Restaurant Plans
Hungry8 may offer paid restaurant plans, add-ons, boosted visibility, points packages, setup services, or other business features through web checkout or invoice. Prices, plan names, included features, usage limits, SMS or email allowances, and renewal terms are shown at purchase or in the restaurant portal.
Unless stated otherwise at purchase, subscriptions renew automatically until canceled. You are responsible for applicable taxes, overages, and charges incurred by your restaurant account. Cancellations generally stop future renewals but do not automatically refund past charges. We may change plan features or pricing with notice where required.

10. Acceptable Use
Do not use Hungry8 to:
- Break laws or violate another person's rights.
- Scrape, harvest, copy, or bulk export platform data without permission.
- Reverse engineer, probe, overload, attack, or interfere with Hungry8 systems.
- Create fake accounts, fake reviews, fake visits, or misleading business claims.
- Buy, sell, or condition reviews on a required positive or negative sentiment.
- Upload malware, spam, unauthorized promotions, or content you do not have rights to use.
- Use automated tools to manipulate recommendations, points, claims, analytics, or rankings.
11. Third-Party Services
Hungry8 may rely on third-party services for maps, directions, payments, authentication, analytics, messaging, email, SMS, gift cards, hosting, customer support, restaurant data, and other functions. These services may have their own terms and privacy policies. We are not responsible for third-party services, restaurant websites, delivery platforms, map directions, payment processors, or gift card providers.
12. Text Messaging
If you provide your mobile number through the Hungry8 website chat widget or another approved Hungry8 opt-in flow, you may choose to receive customer care, account notification, or promotional text messages from Whistling in the Dark Ventures LLC DBA Hungry8. Message frequency varies. Message and data rates may apply. Consent is not a condition of purchase. Reply STOP to unsubscribe or HELP for help.
13. Intellectual Property
Hungry8, including our name, logo, design, software, interfaces, text, graphics, and platform features, belongs to Hungry8, Whistling in the Dark Ventures LLC DBA Hungry8, its licensors, or other authorized rights holders. You may use Hungry8 only as allowed by these terms. We do not grant you ownership of our service, brand, data, software, or content.
If you submit feedback or suggestions, you allow us to use them without restriction or compensation.
14. Privacy
Our Privacy Policy explains how we collect, use, and share information. By using Hungry8, you also agree to the Privacy Policy.
15. Disclaimers
Hungry8 is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and reliability.
We do not guarantee that Hungry8 will be uninterrupted, error-free, secure, current, profitable for restaurants, or that a recommended restaurant will meet your expectations.
16. Limitation of Liability
To the maximum extent permitted by law, Hungry8, Whistling in the Dark Ventures LLC DBA Hungry8, and our owners, employees, contractors, service providers, and partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost revenue, lost data, loss of goodwill, inaccurate restaurant information, food-related issues, reward availability, third-party services, or decisions made from using Hungry8.
To the maximum extent permitted by law, our total liability for any claim related to Hungry8 will be limited to the greater of $100 or the amount you paid Hungry8 for the service giving rise to the claim in the three months before the claim arose.
17. Indemnity
You agree to defend, indemnify, and hold harmless Hungry8, Whistling in the Dark Ventures LLC DBA Hungry8, and their owners, employees, contractors, service providers, and partners from claims, damages, liabilities, costs, and expenses arising from your use of Hungry8, your content, your restaurant listing or claim, your violation of these terms, your violation of law, or your infringement of another person's rights.
18. Changes to Hungry8 or These Terms
We may update Hungry8, add or remove features, change eligibility for features, or modify these terms. If changes are material, we will take reasonable steps to notify users, such as posting updated terms or providing notice in the app, website, or restaurant portal. Continued use of Hungry8 after changes become effective means you accept the updated terms.
19. Disputes and Governing Law
These terms will be governed by applicable United States law and the laws of Wyoming, unless applicable law requires otherwise. Disputes that cannot be resolved informally will be handled in courts or forums with proper jurisdiction under applicable law.
